These terms are an agreement between me — Adhemas Batista, publishing creative software under the name I'm Selling Colors (imsellingcolors.tools) — and you, the person or company using one of my tools, such as Galeria. Using a tool, buying a license, or entering a license key means you accept these terms. If you accept them for a company, you're confirming you're allowed to do that on its behalf.
A few words used below: a tool is one of my apps together with its interface, code, and built-in materials. An export is anything you create with a tool — a video, GIF, image sequence, or other file. Exports don't include the tool itself, its code, or license keys. A company means one single legal entity — sister companies, clients, and partners each count as their own.
Every tool can be used without paying. In the free version, exports carry a small watermark and are meant for evaluation, learning, and personal, non-commercial sharing. If you post free-version exports publicly, leave the watermark exactly as it is — cropping it, covering it, or editing it out isn't allowed, and neither is using free-version exports in paid or commercial contexts. When a project turns commercial, pick up the matching license below.
Buying a license grants you a limited, non-exclusive, non-transferable right to use the tool within the tier on your receipt. Every tier removes the export watermark; they differ in who may use the tool and for what.
For your own experiments, learning, personal posts, and portfolio. It doesn't cover paid work, client projects, advertising, or anything done for a business — including your own.
One named person may use the tool for anything, including freelance and client work. If a company bought the seat, it may pass the seat to a replacement when the original person permanently stops using the tool — but not rotate one seat between several people.
Up to ten people inside a single company may use the tool for any purpose. Swap people in and out as your team changes, as long as no more than ten are covered at once and access isn't opened up beyond the company.
Need more seats, multiple entities under one agreement, or something unusual (embedding a tool in your product, white-labeling, client-facing access, source code)? Those all need a written custom agreement — email me first.
I claim no ownership over your exports. Anything you create with a licensed tool can be used, edited, published, sold, licensed, or handed to a client — commercially or not, at any scale. There are no extra fees tied to audience size, revenue, print runs, or how big your client is.
People who receive your exports (clients, audiences, customers) don't need their own license. A license is only needed by whoever actually operates the tool.
Two honest caveats: you're responsible for having the rights to the images and materials you bring into the tool, and I can't guarantee any export is unique or protectable as a trademark — other users may create similar things with the same tool.
Your key is personal. Keep it private, and don't publish, resell, lend, or share it beyond the people your tier covers. If you think your key leaked, contact me and I'll replace it. Licenses can't be transferred to someone else without my written OK (the seat-replacement rule in Commercial and Studio tiers is the exception).
The tools are licensed to you, not sold — the software itself stays mine. A few things are off-limits:
Screenshots, reviews, tutorials, and teaching with the tools are welcome — just don't expose keys or give others interactive access.
Purchases run through Gumroad, which acts as the merchant of record — it handles checkout, taxes, receipts, and refund processing under its own terms. If a purchase isn't working out, you can request a refund within 14 days. If a purchase is refunded, disputed, or charged back, the license ends and its key stops working.
My tools run entirely in your browser. Your images, videos, and projects are processed on your own machine and are never uploaded to me. The only network call a tool makes for licensing is verifying your key with Gumroad. No accounts, no tracking of your creative work.
One-time licenses don't expire, and updates to the same tool are included as I release them. That said, I'm one person: I can't promise any specific feature, browser, or hosting arrangement will exist forever, and support is provided on a best-effort basis. If a tool is ever discontinued, everything you already made with it remains yours.
The tools are provided "as is," without warranties of any kind, and my total liability under this agreement is capped at the amount you paid for your license. These terms are governed by the laws of California, USA. I may update this document as the tools evolve — the date at the top tells you when it last changed, and meaningful changes apply from the date they're posted.
